On September 17, 2021, a jury in Broward County Circuit Court returned a verdict in favor of our clients who were forced from their first floor condominium unit in Palm Aire, Building 27, in Pompano Beach in 2016 after experiencing significant water intrusion into their home which originated from a condo unit located on the third floor above theirs.  The jury award was in excess of $ 101,000 for personal property damage, loss of use and the inconvenience for being forced from their home.

The flooding occurred as a result of a shady laborer hired by the company who bought the third floor unit with the intent to flip or rent it out for a profit.  While the work was being performed, the laborer left the bathtub running while he listened to music.  The bathtub overflowed and substantial amounts of water discharged and leaked down into the first floor unit.  After the walls began warping and mold began to develop, our clients developed health symptoms which forced them to flee their home.  Our client’s condominium unit was subsequently lost in foreclosure as our clients could not afford to both rent another residence and keep up with their mortgage payments.

The contractor who caused the damage lied claiming he never performed any work inside the unit even though this testimony contradicted a prior written statement where he admitted performing work in the condo for the owner of the upstairs unit, BOZO I, LLC.  Further, there was evidence of the contractor was not licensed to perform work in Broward County.  Contracting without a license is a third degree felony in the State of Florida.  There was also photographic evidence of work being performed in the unit during the time the owner claimed no work was being conducted.

The Court rejected defenses of the Defendant that the owner was not liable because the contractor was a claimed independent contractor.
