On September 4, 2023, The Mold Lawyers secured a final judgment in the amount of $425,000 against the Carillon Condominium Association in Lake Worth, Florida. The case revolved around the Association’s neglect and failure to maintain a leaking roof over our client’s condominium on-going since 2017. This neglect led to severe water intrusion and subsequent mold growth, affecting not only the structural integrity of the property but also the health and well-being of our clients.  Ultimately, the water intrusion forced our clients from their home.

A Lengthy Battle for Justice

The road to justice was far from easy. Despite clear evidence showing that water was infiltrating into the interior of the premises, the Association remained adamant in their denial that there was anything wrong with the roof. Their refusal to take responsibility led to protracted litigation and undue hardship for our client when they had to leave their retirement home.

The Importance of Expert Opinion

To conclusively prove the Association’s failure to maintain the roof, The Mold Lawyers had to hire experts in the field of construction and water intrusion to examine the property and pinpoint the exact areas where the roof was improperly installed. These experts were also able to identify how water was entering the interior during heavy and wind-driven rain events. Their findings were instrumental in strengthening our case and establishing the culpability of the Carillon Condominium Association.

Legal Precedent and Public Impact

This case sets a vital precedent for homeowner and condominium associations across the state of Florida.  Condominium Associations have a legal obligation to maintain the shared and common elements of the property, including the roof at all times. Failure to do so can have dire financial and legal repercussions. Our win sends a clear message: refusal to acknowledge evident problems will not be tolerated.
