Our clients leased a commercial unit in Delray Beach, Florida, which soon proved to be uninhabitable due to toxic mold, asbestos, and volatile organic compounds (VOCs). Despite repeated complaints and requests for remediation, the landlord failed to make the premises safe for occupancy, leading to serious health issues and business disruption.

We filed suit against SW Delray Artist Alley, LLC for:

  • Negligence in maintaining the premises;

  • Breach of contract, including failure to return the security deposit;

During the course of litigation, the defendant challenged critical aspects of the case— including the filing of an appeal.  However, we prevailed on appeal, securing that the landlord was liable for our client’s damages.  The appellate victory was pivotal in strengthening our clients’ negotiating position.

Following the successful appeal and shortly before trial, we secured a $435,000 settlement, fully resolving the claims and compensating our clients for their losses, including:

  • Business interruption and lost profits;

  • Medical treatment and personal injury damages;

  • Relocation and restoration costs.
